Booking Terms & Conditions

These Terms and Conditions apply to purchases of services made through Over The Bridge ("we", "us", "our") via our website or other approved online booking platform.

By purchasing a service from us, you agree to these Terms and Conditions.

1. Services

The service purchased will be the service described on the relevant booking or service page at the time of purchase. Details such as the workshop content, learning objectives, date, time, location, duration, delivery format, inclusions and price will be provided during the booking process.

Our services provide psychology-related education, information and learning opportunities. Unless expressly stated otherwise, workshops are educational in nature and do not constitute individual psychological assessment, diagnosis, counselling, psychotherapy, medical care or other personalised clinical services.

We will make reasonable efforts to ensure that information displayed online is accurate and up to date.

2. Booking and acceptance

A booking is made when you complete the online purchase process and payment has been successfully received, unless otherwise stated during booking.

We will provide confirmation of your booking by email or through the online booking system.

If we are unable to accept your booking, we will notify you and refund any payment made for the unavailable service.

You are responsible for providing accurate contact details and checking your booking confirmation for relevant information, including the workshop date, time and attendance instructions.

3. Prices and payment

All prices are stated in Australian dollars unless otherwise specified. The total price payable will be displayed before you complete your purchase.

Payment must be made using one of the payment methods made available during the booking process. Any applicable fees or charges will be disclosed before payment is completed.

Where a workshop offers different pricing categories, such as student, concession, early-bird or professional rates, eligibility requirements will be stated where applicable.

4. Changes to the service

We may need to make reasonable changes to the service, including changes to the time, location, personnel, program or other arrangements. Where a significant change is required, we will provide reasonable notice where practicable.

If we cancel a service or make a significant change that means you can no longer reasonably participate in the service, you may be entitled to a refund or other remedy as required by Australian Consumer Law.

5. Cancellation by the customer

All workshop bookings are subject to our Cancellation & Refund Policy, which sets out the applicable cancellation conditions, refund eligibility and any fees that may apply. Please review this policy before completing your booking.

Unless otherwise stated for a particular service, you may request cancellation of your booking by contacting us using the details provided on our website. Our cancellation and refund policy for the relevant service will apply.

Any cancellation policy will not limit or exclude your rights under the Australian Consumer Law. Where the law requires a refund or other remedy, we will provide the applicable remedy.

6. Cancellation by us

We reserve the right to cancel a service where reasonably necessary, including because of insufficient bookings, illness, safety concerns, venue issues, unforeseen circumstances or circumstances beyond our reasonable control. If we cancel a service and you have paid for it, we will provide a refund or other remedy as required by law.

Unless required by law, we are not responsible for any additional costs you incur in connection with a cancelled service, such as travel, accommodation or other third-party expenses.

7. Consumer guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

For major failures with the service, you are entitled:

  • to cancel your service contract with us; and

  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

If the failure does not amount to a major failure, you are entitled to have the problem rectified within a reasonable time. If this is not done, you may be entitled to cancel the service contract and obtain a refund for the unused portion.

Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

8. Customer responsibilities

You agree to:

  • provide accurate information when making a booking;

  • follow reasonable instructions provided in connection with the service;

  • comply with applicable venue rules and safety requirements; and

  • behave appropriately and respectfully towards our staff, volunteers, contractors and other participants.

Where a service has specific requirements, such as age restrictions, equipment requirements, health or safety requirements, these will be disclosed before purchase where reasonably practicable.

9. Failure to attend

If you do not attend a booked service, any applicable cancellation or non-attendance policy displayed at the time of booking will apply. Nothing in this section limits any rights you may have under the Australian Consumer Law.

10. Third-party services

Some services may involve third-party venues, suppliers, contractors, instructors, performers or service providers. Where a third party is involved, we will take reasonable steps to ensure that the service is provided as described. Nothing in these Terms and Conditions limits any rights you may have under the Australian Consumer Law.

11. Liability

To the maximum extent permitted by law, we are not responsible for loss or damage that is not reasonably foreseeable or that results from circumstances outside our reasonable control.

Nothing in these Terms and Conditions excludes, restricts or modifies any liability that cannot legally be excluded, restricted or modified. Where permitted by law, our liability will be limited to the remedies available under the Australian Consumer Law and the terms applicable to the particular service.

12. Privacy

We collect and use personal information provided during the booking process for purposes including processing your booking, receiving payment, communicating with you about the service and administering our organisation.

Personal information will be handled in accordance with our Privacy Policy, available at overthebridge.com.au/privacy-policy.

13. Online payments

Payments may be processed through third-party payment providers. We do not generally receive or store complete payment card details where payment processing is handled by a third-party payment provider. You are responsible for ensuring that the payment information you provide is accurate and that you are authorised to use the payment method.

14. Intellectual property

Unless otherwise stated, materials provided as part of the service, including written materials, photographs, videos, graphics, documents and other content, remain the property of Over The Bridge or the relevant rights holder. You must not reproduce, distribute, sell or commercially exploit such materials without permission, except where permitted by law.

15. Events and activities

Where the service involves attending an event, workshop, class, performance or other activity, participants must comply with reasonable instructions from event organisers, staff, volunteers and venue personnel.

We reserve the right to refuse participation or ask a person to leave where reasonably necessary for safety, security or the orderly operation of the event, subject to applicable law.

16. Force majeure

We will not be responsible for failure or delay in providing a service where the failure or delay results from circumstances beyond our reasonable control, including natural disasters, severe weather, government restrictions, venue closure, industrial action, public emergencies, illness or other unforeseen circumstances.

Where such circumstances prevent the service from being provided, we will communicate with affected customers and provide any refund or other remedy required by law.

17. Complaints and enquiries

If you have a question, complaint or concern about a service, please contact us as soon as reasonably practicable:

Email: admin@overthebridge.com.au
Phone: 0477 453 264

We will endeavour to respond to complaints and resolve issues fairly and promptly.

18. Changes to these Terms and Conditions

We may update these Terms and Conditions from time to time. The Terms and Conditions applying to your purchase will generally be those displayed at the time you complete your booking. Any changes will not affect rights or obligations that have already arisen unless permitted by law.

19. Governing law

These Terms and Conditions are governed by the laws of Western Australia, Australia.

Any dispute will be subject to the applicable laws and courts of Western Australia, subject to any rights or remedies available under Australian Consumer Law.

20. Australian Consumer Law

Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Competition and Consumer Act 2010 (Cth), including Schedule 2 (Australian Consumer Law), or any other applicable legislation. If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue to apply.
